Program Name and Description

The SMS messaging program is operated by Axion AI Technologies LLC (the “Program”). The Program uses AI-assisted voice and SMS agents to follow up with individuals and businesses who have contacted us, submitted an inquiry, or requested information. Messages are conversational and transactional in nature and relate to customer support, appointment scheduling, service updates, follow-up communications, and account notifications. The Program does not send marketing or promotional messages without separate express consent.

Consent to Receive Messages

By providing your mobile phone number and opting in through our website, phone system, or customer inquiry forms, you expressly consent to receive SMS text messages from Axion AI Technologies LLC at the number provided. Consent is not a condition of any purchase. You represent that you are the subscriber or customary user of the phone number you provide and are authorized to opt in.

Message Frequency

Message frequency varies based on your interaction with the Program. You may receive messages in response to your inquiries, to schedule or confirm appointments, or to provide service-related updates.

Message and Data Rates

Message and data rates may apply for any messages sent to you by us and to us by you, depending on your wireless carrier plan. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Opt-Out Instructions

You can cancel the SMS service at any time. Just text “STOP” to the number from which you receive our messages. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages.

Privacy and Data Sharing

Your use of the Program is also governed by our Privacy Policy, available at axionaitechnologies.com/privacy-policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services strictly as necessary to operate the Program. All other categories of data sharing described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

User Responsibilities

If you use our Services to send messages to your own recipients, you are solely responsible for:

• Obtaining all required express consent from your recipients prior to messaging

• Ensuring your messages comply with the TCPA, CTIA Messaging Principles, applicable state laws, and carrier regulations

• Providing clear and conspicuous opt-out mechanisms to your recipients

• Obtaining all required legal consent before recording calls or processing communications

Axion does not verify your recipients’ consent and is not liable for your compliance with telecommunications, recording, or messaging laws.

Acceptable Use

You agree not to use the Services or the Program to send unlawful, deceptive, fraudulent, harassing, or prohibited content, including but not limited to content prohibited by carrier rules (such as messaging related to prohibited categories). We may suspend or terminate access for any violation.

State-Specific Provisions

We honor applicable state messaging and consumer protection laws, including the Texas Business and Commerce Code provisions governing telephone and text solicitation (including Texas SB 140) and the Texas Data Privacy and Security Act (TDPSA). Where state law provides additional opt-out, disclosure, or consent rights, those rights apply.

Service Availability

The Services and the Program are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, message delivery, or system availability.

Limitation of Liability

To the maximum extent permitted by law, Axion is NOT liable for:

• Data loss

• Business interruption

• Delayed or undelivered messages

• Indirect, incidental, or consequential damages

You assume responsibility for legal compliance (especially telecom/SMS laws) and use of collected data.

Changes to These Terms

We may update these Terms at any time. Changes will be reflected by updating the Effective Date. Continued use of the Services or the Program constitutes acceptance of the updated Terms.
